商标律师 are legal professionals who specialize in the area of intellectual property law that deals with trademarks, service marks, and trade dress. They help clients to obtain, maintain, and enforce trademark rights, and they advise clients on trademark-related issues. Trademark lawyers may also represent clients in trademark infringement lawsuits.

Responsibilities

The day-to-day responsibilities of a trademark lawyer may include:

  • Conducting trademark searches to determine if a mark is available for use
  • Filing trademark applications with the United States Patent and Trademark Office (USPTO)
  • Prosecuting trademark applications before the USPTO
  • Maintaining trademark registrations
  • Enforcing trademark rights against infringers
  • Advising clients on trademark-related issues

Education and Training

Trademark lawyers must have a Juris Doctor (J.D.) degree from an accredited law school. They must also pass the bar exam in the state in which they wish to practice law. Some trademark lawyers also have a Master of Laws (LL.M.) degree in intellectual property law.
