디지털 거버넌스 온라인 공개 수업에 오신 것을 환영합니다.

Jean Monnet Centre of Excellence의 디지털 거버넌스 부서에서 제공하는 디지털 거버넌스 온라인 공개 강좌에 오신 것을 환영합니다. 'Centres of Excellence'는 사회적인 영향력을 가지고 국제 규모의 최첨단 연구를 수행하는 우수한 연구 단체에 수여되는 명칭입니다. 유럽 위원회는 Erasmus 및 Leeds(영국), Bar-Ilan(이스라엘) 법과 대학에 디지털 거버넌스(DIGOV)의 Jean Monnet Centre of Excellence 명칭을 부여했습니다. DIGOV는 빅 데이터와 인공 지능이 사회 전반에서 보다 견고하게 활용될 수 있도록 법률을 구상하는 방법을 연구하는 조직입니다. 디지털 거버넌스에 관한 컨퍼런스와 워크샵을 주최하고, 객원 연구원 프로그램을 진행하며, 사회의 이해관계자들을 연결합니다. 본 디지털 거버넌스 온라인 공개 수업처럼, DIGOV가 수행한 연구 내용을 보급하는 것은 DIGOV 활동의 중요한 부분입니다. 본 과정은 법적 혼란 및 유럽 정책과 관련된 디지털 거버넌스의 기본 과제를 이해하는 것에 중점을 두고 있습니다. 유럽 연합의 법과 정치 내에서 디지털 기술이 야기하는 충격을 다룰 것입니다. 또한 유럽 경제의 성장 옵션, 빅 데이터와 개인 정보 보호의 관계, 인공 지능이 불러일으킬 기회와 위협, 디지털 상품에 대한 책임을 살펴보고, 디지털 시장에서의 경쟁을 관리하는 법과 규제의 적용, 디지털화의 윤리 및 경영에 대해서도 논의할 것입니다.

디지털 시대의 법 소개

첫 번째 모듈에서는 Ittai Bar-Siman-Tov 박사와 함께 디지털 시대와 법 사이의 관계를 살펴볼 것입니다. 디지털 시대에서 법의 역할, 빅 데이터가 법과 법률 업무에 미치는 영향에 대해서 논의합니다. 데이터 과학이 법률 연구에 미치는 영향도 함께 알아보도록 하겠습니다. 이번 모듈은 몇 가지 강의 동영상과 읽기 자료, 토론 프롬프트로 구성됩니다. 토론 프롬프트에서 다른 수강생들과 교류하고 적극적으로 토론에 참여하기를 권장합니다. 토론에 '정답'은 없다는 점을 명심하세요. 토론 프롬프트의 목적은 주제에 관한 서로 다른 생각과 관점을 공유하는 것입니다.

전자 민주주의

이 모듈에서는 전자 민주주의의 개념을 알아보겠습니다. 디지털 공간이 민주적 심의에 새로운 장을 열어 참여 장벽을 낮추고 비전의 투명성을 실현한 방법도 함께 살펴볼 것입니다. 또한 전자 민주주의의 함정과 과제에 대해 논의하고, 미래를 예측해 보겠습니다. 전문가인 Oren Perez 교수가 흥미로운 통찰과 연구 결과를 제시합니다. 이번 모듈은 몇 가지 강의 동영상과 읽기 자료, 토론 프롬프트, 퀴즈 문제로 구성되어 있습니다. 토론 프롬프트에서 다른 수강생들과 교류하고 적극적으로 토론에 참여하기를 권장합니다. 토론에 '정답'은 없다는 점을 명심하세요. 토론 프롬프트의 목적은 주제에 관한 서로 다른 생각과 관점을 공유하는 것입니다. 퀴즈 문제는 동영상 강의 내용과 심화 학습을 위한 읽기 자료를 바탕으로 출제됩니다.

이 모듈에서는 공공 영역의 디지털화에 대한 지식을 습득하며, 법치주의를 위협하는 거버넌스 위험을 알아봅니다. 의사 결정 체계, 감시 체계, 현행 법률 구조의 결점에 주의를 기울여 관리 당국이 가하는 위해나 부정 행위로부터 보호할 수 있도록 합니다. 이는 현재의 법적 틀에 미치는 신기술의 파괴적인 영향에 대한 설명으로 이어집니다. 이 모듈에는 세 가지 토론 프롬프트가 포함되어 있습니다. 프롬프트에서 이 복잡한 주제에 대한 여러분의 생각과 관점을 공유해 보세요. 프롬프트에 답하면서, 여러분과 다른 수강생들은 서로에게 배우고 동영상 강의와 읽기 자료를 통해 얻은 지식을 교환할 수 있습니다. 또한 여러분이 자신의 출신 국가에 기반한 의견을 제시한다면, 서로의 시야를 넓히고 전자 정부에 대한 세계적인 그림을 그려보는 데 도움이 될 것입니다.

온라인 법원

이번 모듈에서는 비교적 최근에 발전한 온라인 법원에 대해 자세히 살펴봅니다. 법원은 변화를 선호하지 않는 동시에 변화에 저항력이 있는 기관이지만, 최근 몇 년 사이에 전통적인 법원 모델이 모든 법원 및 법원 이용자들에게 용이하지 않다는 점이 드러나고 있습니다. 법원은 여러 사건들로 업무가 과중되어 권리 행사를 원하는 사람들 모두가 법원을 이용하지 못하고 있습니다. 이러한 상황을 고려해, 법원이 절차를 개편하고 기술을 활용해 일반인들이 자신의 권리를 주장 및 보호할 수 있도록 지원해야 한다는 주장이 제기되고 있습니다. Ayelet Sela 박사와 함께 Ayelet Sela 박사가 사법 접근성 향상에 초점을 맞춰 온라인 법원의 동기와 혁신성을 설명합니다.

디지털 시장의 경쟁과 규제

이 모듈에서는 디지털 시장의 경쟁과 규제가 고객과 기업을 포함한 모든 시장 참여자들에게 최상의 결과를 보장하기 위해 수행하는 역할을 알아볼 것입니다. 모듈의 마지막 부분에서는 디지털 시장의 경쟁 및 규제의 기본 개념과 시장의 경쟁 상태 유지를 위해 관리 당국이 시장에 개입해야 하는 경우를 살펴봅니다. 또한 이 모듈을 통해 온라인 플랫폼과 디지털 시장의 공통적인 특징, 다면적 플랫폼 시장의 특징 및 경쟁 관련 법률과 규제의 기본 원칙을 확인할 것입니다. 구글 및 아마존과 같은 거대 기술 기업의 관행에 경쟁법이 개입한 사례와 전 세계 거대 기술 기업의 다양한 기업적 관습에 가해진 규제 사례도 함께 자세히 알아보겠습니다.

데이터의 소유권

본 모듈에서는 공정하고 효율적인 데이터 사용을 위한 재산권의 역할에 대해 알아봅니다. 데이터 재산권 할당은 대체로 누가 데이터로 무엇을 할 수 있는지, 그리고 데이터 사용으로 누가 이득을 얻는 지를 결정합니다. 데이터 소유권은 순수 공공 소유부터 순수 사적 소유까지 다양한 범위로 설계할 수 있습니다. 실제로 데이터 소유권에 관한 법을 상세하게 설계하고 소유권을 할당해야 개인의 행동을 사회적 목표에 일치시킵니다.
