Arbitration is a form of alternative dispute resolution (ADR) in which two or more parties agree to have their dispute resolved by one or more neutral third parties, known as arbitrators. Arbitration is often used in commercial disputes, but it can also be used in other types of disputes, such as employment disputes and personal injury cases.

Benefits of Arbitration

There are several benefits to arbitration, including:

  • Arbitration is generally faster and less expensive than litigation. The arbitration process is typically more streamlined than the litigation process, and there are fewer formal rules and procedures to follow.
  • Arbitration is private and confidential. The arbitration process is closed to the public, and the parties are not required to disclose any information about the dispute to anyone outside of the arbitration proceeding.
  • Arbitration is binding. The parties are bound by the arbitrator's decision, and there is no right to appeal the decision to a court.

How Arbitration Works

The arbitration process typically begins with the parties agreeing to arbitrate their dispute. This agreement can be included in a contract or it can be made after a dispute has arisen. Once the parties have agreed to arbitrate, they will select one or more arbitrators to hear their case. The arbitrators will then hold a hearing, during which the parties will present their evidence and arguments. After the hearing, the arbitrators will issue a decision, which is binding on the parties.
